The Kerala high court has asked the Central Government to clarify on who governs the CBSE (Central Board of Secondary Education) – Central or State Government. This followed the petition filed by the state government opposing the order of the single bench claiming that state government’s criteria of 3 acres of land and minimum of 300 students to operate CBSE schools are unreasonable and irrational.

While hearing the case, the court directed to get clarification from central government that who controls the CBSE schools as per Right to Education Act – the state government or the centre.

The high court’s order to probe on which body has authority over the CBSE schools came after it had ordered a stay on the state’s rule saying five years of experience, three acres of land, UID registration and 300 students were the minimum requirements to obtain NOC from the state government to run CBSE schools.

The petition filed by the government highlighted that NOCs (No Objection Certificates) .are required to ensure the quality of education so as to restrict large number of CBSE schools from coming up.

 As per the state government, it had been issuing NOCs to CBSE schools unlike the prior government in order to maintain the quality of education.

The orders came after 15 CBSE schools had challenged the rules formed by the state through KER (Kerala education rules) for securing new NOCs to operate schools.
